IHBC VP notes new SIs for England include fees; operating from 17 Jan

Mike BrownStatutory Instrument (SI) 2017 No. 1314 The Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations amends the 2012 SI of the same name, such that planning fees must now be paid for applications made under an Article 4 Direction.

Mike Brown, IHBC Vice President said: ‘This may have an impact on the public’s support for A4Ds but will remove a major disincentive on Council’s to make them in the first place.

It also extends the fee regime to include conditions, and increases planning fees by some 20%.  So it’s good to see government looking to make LPAs more financially viable but, without hypothecation, there’s no guarantee that hard-pressed Councils will ring-fence the money within planning budgets.’

The SI will come into force on the 17 January 2018.
